1. Definitions
- Account
- The user credentials and associated data created when you register for the Service.
- Alerts
- TradingView™ alerts or any comparable signal that you route to the Service.
- Broker
- Any third‑party brokerage, exchange or liquidity venue (e.g. MetaTrader 5, Binance) to which the Service can send orders.
- Content
- All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials uploaded, posted or transmitted via the Service.
- Platform
- Pine2Trade’s proprietary automation infrastructure, including the Website, EA, REST/WebSocket gateways, dashboards and documentation.
- Subscription
- A fee‑based licence tier that governs the scope (number of accounts, symbols, features) and duration of your access to the Service.
2. Eligibility
You must (i) be at least 18 years old (or the age of majority in your jurisdiction) and (ii) have the legal capacity to enter into a binding contract. By using the Service on behalf of a company or other legal entity you warrant that you have authority to bind that entity and that “you” and “your” refer to that entity and its affiliates.
3. Nature of the Service & Risk Warning
- Automation Tool — Not Investment Advice. Pine2Trade converts Alerts into orders sent to your Broker. We do not provide trading advice, portfolio management or execution services. You remain solely responsible for the strategy, timing, sizing and suitability of every order.
- High‑Risk Activity. Trading leveraged products, derivatives or digital assets involves a high risk of loss — including losses exceeding initial capital. By using the Service you expressly acknowledge these risks and confirm that you have the requisite knowledge to trade.
- Past Performance. Historical results, back‑tests or testimonials do not guarantee future returns.
- No Regulatory Oversight. Pine2Trade is not authorised by the Dutch Authority for the Financial Markets (AFM) or any other financial regulator and does not hold client funds.
4. Third‑Party Platforms & Dependencies
The Service relies on infrastructure and APIs operated by Brokers, cloud providers (e.g. Azure), internet service providers and TradingView™. Pine2Trade has no control over their availability, latency, pricing or behaviour. Outages, maintenance or policy changes at a third party may delay or prevent execution, causing losses for which we are not liable.
5. Account Registration & Security
- Provide accurate information and keep it updated.
- Keep credentials, API keys and device IDs confidential.
- Limit access to authorised persons and secure hardware.
- Notify us immediately at support@pine2trade.com of any suspected breach.
We may suspend or terminate access if we believe your Account is compromised.
6. Licence & Acceptable Use
We grant you a revocable, non‑exclusive, non‑transferable, limited licence to install and use the EA and Platform strictly in accordance with (i) these Terms, (ii) the scope of your active Subscription, and (iii) applicable law. You shall not:
- copy, modify, reverse‑engineer, decompile or disassemble the Platform;
- rent, lease, resell, sublicense, time‑share or otherwise exploit the Service for third parties;
- use the Service for any unlawful, infringing, defamatory, obscene or fraudulent purpose;
- transmit malware, denial‑of‑service attacks or unsolicited advertising;
- violate export restrictions, sanctions or KYC/AML regulations.
7. Subscriptions, Billing & Taxes
7.1 Fees
Subscriptions, prices and features are posted on our Website and may change upon 30 days’ notice. Fees are charged in euros (EUR) and include VAT where legally required.
7.2 Automatic Renewal
Unless cancelled at least 24 hours before the end of the current billing cycle, your Subscription renews automatically and the payment method on file is charged.
7.3 Refund Policy
All sales are final. We do not offer pro‑rata refunds for partial periods or unused features. Statutory cooling‑off rights (EU Directive 2011/83/EU) remain unaffected for consumers who have not yet downloaded or used the digital content.
8. Data Protection & Privacy
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and our separate Privacy Policy. Among other things we may:
- capture device IDs to detect trial abuse and maintain service integrity;
- record anonymised telemetry (latency, error codes) to improve performance;
- store trading logs (timestamps, symbol, quantity) for 90 days unless extended by law or requested by you.
We do not sell or share signal data with third parties for marketing.
9. Service Availability, Maintenance & Force Majeure
The Service is provided on an “as‑is” and “as‑available” basis. We strive for 99.5 % uptime but do not guarantee uninterrupted, timely or error‑free operation. Pine2Trade is not liable for delay or failure caused by events beyond our reasonable control, including but not limited to natural disasters, power outages, cyber‑attacks, war, pandemics, strike or failure of internet backbones or cloud providers.
10. Intellectual Property
All intellectual‑property rights in the Platform, EA, documentation, trademarks (“Pine2Trade”, logos) and any derivative works belong exclusively to Pine2Trade or its licensors. Nothing in these Terms transfers ownership. You may display our marks solely to identify integration with the Platform (fair use) and must comply with our brand guidelines.
11. Disclaimer of Warranties
To the maximum extent permitted by law, Pine2Trade expressly disclaims all warranties, whether express, implied or statutory, including but not limited to merchantability, fitness for a particular purpose, non‑infringement, title, quiet enjoyment and accuracy of data.
12. Limitation of Liability
Neither Pine2Trade nor its directors, employees, agents or suppliers shall be liable for any indirect, incidental, special, consequential or punitive damages (including lost profits, trading losses, loss of data or goodwill) arising out of or relating to the Service—even if advised of the possibility. In no event shall our aggregate liability exceed the total fees paid by you to Pine2Trade in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of liability; in such cases our liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Pine2Trade, its affiliates and personnel against any third‑party claim, demand, loss, damage, penalty or expense (including reasonable legal fees) arising out of or related to: (i) your breach of these Terms; (ii) your Content; (iii) your breach of any law or regulation; or (iv) any dispute with a Broker or other third party.
14. Third‑Party Links
Links to external sites or services are provided for convenience only. Pine2Trade does not endorse and is not responsible for any third‑party content, products or services. Your use of third‑party sites is at your own risk.
15. Termination
Either party may terminate these Terms at any time by written notice or via the Account dashboard. Upon termination:
- your licence to the EA and Platform immediately ends;
- pending orders may fail to execute; and
- Sections 3–5, 8–13, 17–19 survive.
We may refuse or suspend Service without notice if we reasonably suspect fraud, misuse or legal risk.
16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with Dutch law, excluding conflict‑of‑law rules. Any dispute that cannot be settled amicably within 30 days shall be finally resolved under the Netherlands Arbitration Institute (NAI) rules by a single arbitrator seated in Amsterdam, in English. Judgment on the award may be entered in any court of competent jurisdiction. Consumers resident in the EU retain the right to submit disputes to the EU Online Dispute Resolution platform (ODR).
17. Severability
If any provision is held invalid or unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will remain in full force and effect.
18. Changes to These Terms
We may modify these Terms by posting a revised version and updating the “Last updated&
